248.10 HOURS; OVERTIME; SICK TIME; HOLIDAYS; VACATIONS; BEREAVEMENT LEAVE.
   (a)   Hours. All employees of the Police Department shall be required to work hours in accordance with the standards established in this section and shall conform to all applicable State and Federal standards and laws.
      (1)   Sworn police patrol officers. The work standard applying to all sworn police patrol officers shall be based upon a twenty-eight day work period, beginning on a Saturday and ending on the fourth Friday following the beginning Saturday. Within this twenty-eight day standard, all fu11-time sworn patrol officers shall be required to work 168 hours. Any time worked in excess of the 168th hour in any twenty-eight day standard shall be compensated in accordance with the overtime rate as defined in paragraph (b)(1) hereof.
      (2)   Non-sworn police personnel. The work standard applying to all non-sworn police personnel shall be based on a seven-day period, beginning on Monday and ending on the following Sunday. Within this seven-day standard, all fu11-time, non-sworn police personnel shall be required to work thirty-five hours during standard office hours. Any hours worked in excess of the thirty-fifth hour through the fortieth hour in any seven-day period shall be compensated at the employee's regular hourly rate. Any hours worked in excess of the fortieth hour in any seven-day period shall be compensated in accordance with the overtime rate as defined in paragraph (b)(2) hereof.
      (3)   Designated administrative personnel. All sworn police officers above the rank of sergeant and all sworn officers assigned to temporary administrative duty (TAD) shall be considered designated administrative officers and shall be subject to the rules and requirements hereinafter set forth. The work standard applying to all designated administrative police personnel shall be based on a twenty-eight day work period, beginning on a Saturday and ending on the fourth Friday following the beginning Saturday. Within this twenty-eight day work standard, all designated administrative officers shall be required to work 160 hours during standard office hours. Hours worked by designated administrative officers above the rank of sergeant in excess of 160 hours in a work period may be claimed as compensatory time.
      The designated administrative officers of the Department above the rank of sergeant are salaried and do not receive overtime, but they may claim compensatory time off when the demand of their work requires them to work beyond forty hours per week.When additional work hours can be reasonably anticipated, prior approval of the Commissioner of Public Health and Safety or the Mayor shall be obtained.
      Compensatory time may be used only after it is earned and it shall be used during the pay period in which it was earned or the pay period after which it was earned.
      Sworn officers of the rank of sergeant and below who are assigned to TAD shall receive overtime pay as provided in paragraph (b)(1) hereof.
   (b)   Overtime.
      (1)   Sworn police officers. The Chief of Police, lieutenants and officers ranked above lieutenant shall not be paid overtime. Any hours worked by other sworn officers in excess of the 168th hour in any twenty-eight day period shall be compensated at a rate of one and one-half times such officers' regular hourly rates.
      (2)   Non-sworn police personnel. Any hours worked in excess of the fortieth hour in a seven-day period shall be compensated at a rate of one and one-half times the employee's regular hourly rate.
   (c)   Sick Time.
      (1)   All full-time employees shall earn and be credited with sick-time hours equivalent to a fourteen-day work period, applicable to the position. One-half of said sick time shall be credited on January 1 of each year and one-half on July 1 of each year. At the time of retirement, unused, accrued sick time may be credited to the maximum allowed by the Illinois Municipal Retirement Fund (IMRF), but such sick time has no cash value. Sick leave shall accrue as designated as long as the employee is on active duty in his or her position.
      (2)   Restrictions and limitations on sick time shall be as follows:
         A.   Any employee on sick time shall take whatever steps are medically necessary to remedy his or her condition and shall not engage in social or commercial pursuits unless specifically authorized by his or her physician. Any employee who engages in commercial or social pursuits on a sick day shall provide, upon request, proof of compliance with this provision. In the event the employee fails to provide the proof of compliance with the foregoing provision, he or she shall not be entitled to any sick time benefit payments. Failure to provide proof of compliance shall be prima-facia evidence of a willful intent on behalf of the employee to violate Departmental rules and shall subject the employee to disciplinary action.
         B.   A letter or report from a medical physician producing a written release to return to work shall be required of every employee at any time an employee is absent from work for three or more paid consecutive days with a reported illness.
         C.   1.   A physical examination by a medical physician may be ordered at any time by the Department for any employee who reports illness using the sick time benefit when there is, as hereinafter defined, reasonable cause to believe that this person is abusing this benefit. The Department reserves the right to select the doctor. This examination will determine the eligibility of the person for sick leave. Any and all sick leave benefits shall be withheld pending compliance by the employee and a favorable report by the doctor. In the event the employee is determined to be fit to work by a physician's examination, he or she shall not be entitled to any sick time benefit payments. Such determination shall be prima-facie evidence of a willful intent by the employee to violate Departmental rules and shall subject the employee to disciplinary action.
            2.   Reasonable cause shall be defined as follows:
               a.   The employee is observed in a social, commercial or recreational pursuit when on sick leave and fails to provide any evidence by way of medical certificate, or otherwise, that his or her condition makes him or her unable to perform his or her duties for the Department.
               b.   The employee, upon appropriate inquiry, fails to give satisfactory indication or explanation of the nature or extent of his or her illness or injury.
      (3)   Any sick time used shall not be credited toward any overtime standards as established in this section.
   (d)   Holidays. All full -time employees of the Department shall be entitled to a maximum of ten paid days for holidays and shall be compensated in accordance with the provisions established in this section. For purposes of compensation, holidays shall be credited toward any overtime standard established in this section.
      (1)   Full-time, non-sworn employees.  All full-time, non-sworn employees and designated administrative and TAD officers of the Department are entitled to be off on the following named holidays: New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, the day after Thanksgiving, Christmas Eve and Christmas Day. In addition, all full-time, non-sworn employees of the Department are entitled to be off for two floating holidays, which shall be determined annually by the Village Manager.
      (2)   Full-time, sworn employees. All full -time, sworn employees of the Department assigned to the Patrol Division are entitled to ten paid days off to compensate them for the named holidays of the Village. In the event that such an employee is scheduled to work on any named holiday, he or she will receive normal compensation for that day. However, sworn employees may request any of these holidays off pursuant to Department guidelines. Any sworn employee who elects to call in sick and utilize sick time credit for the named normal holiday shall not be entitled to a paid day to compensate for that named holiday, unless he or she provides a doctor's verification of illness.
      In order to maintain the proper application and accountability for the paid days which are to compensate for the named holidays, these paid days shall accrue on the day of the holiday, and only then, and after such holiday may be used according to policy.
      Approval of requests for time off on holidays shall be granted in accordance with the same requirements, insofar as applicable, as requests for vacation time. Holidays may not be used to extend vacation time periods unless a holiday occurs within the vacation period.
      Holidays may not be carried over from one year to the next year. Sworn patrol officers may be authorized to carry over up to two holidays to the next year if, due to scheduling, it is not practical to take said holidays in the year earned. Any holidays so carried over shall be taken within the first sixty days of the subsequent year, or they shall be forfeited.
   (e)   Vacations.
      (1)   All sworn, full-time patrol employees of the Department shall be entitled to the following periods of paid vacation leave, subject to availability as determined by the Department and in accordance with the written policy of the Department, as follows:
         A.   Upon completion of one complete and continuous year of service: eighty-four hours of paid vacation (i.e. seven shifts);
         B.   Upon completion of five years of complete and continuous service: 120 hours of paid vacation (i.e. ten shifts); and
         C.   Upon completion of fifteen years of complete and continuous service: 168 hours of paid vacation (i.e. fourteen shifts).
      (2)   All full-time, non-sworn employees of the Police Department and designated administrative and TAD officers shall be entitled to the following periods of paid vacation leave, subject to availability as determined by the Department and in accordance with the written policy of the Department, as follows:
         A.   Upon completion of one complete and continuous year of service: seventy hours of paid leave (i.e. ten working days);
         B.   Upon completion of five years of complete and continuous service: 120 hours of paid leave (i.e. fifteen working days); and
         C.   Upon completion of fifteen years of complete and continuous service: 160 hours of paid leave (i.e. twenty working days).
      (3)   Vacation time shall be credited to each full-time employee on January 1 immediately following the completion of the required number of years of service and every January 1 thereafter.
      (4)   Those employees not working an entire year shall be given vacation time prorated as follows:
         A.   Sworn personnel shall be given twelve hours (i.e. one shift) for each forty-five calendar-day period worked during the preceding partial year.
         B.   Non-sworn personnel, designated administrative personnel and TAD officers, as applicable to their work standard, shall be given one day for each thirty-six calendar-day period worked during the preceding partial year.
      (5)   Those employees submitting their vacation requests by February 15 of the schedule year and thirty days before the effective date requested will, if possible, be given approval by March 15. Where there is a conflict, approval shall be based upon seniority. Once a vacation request is submitted and approved, the vacation may be required to be taken as approved.
      Any vacation request submitted after February 15 must be submitted a minimum of thirty days before the effective date requested, or it may not be approved. There is no requirement that such a request after February 15 will be approved. Such requests shall be considered on a first-received basis without consideration for seniority.
      (6)   Approval will not be granted for two full-time officers in the same division to be on vacation for a period of time beyond two consecutive vacation days.
      (7)   All vacation requests must be for a minimum of two vacation days and a maximum of ten consecutive paid days. Holidays may be used to extend this time off only if the holiday falls within the approved vacation time period.
      (8)   All vacation time must be taken within the calendar year (January 1 through December 31), or be forfeited without compensation. Vacation time may not be accrued from year to year.
   (f)   Bereavement Leave. All Department personnel shall be entitled to two days of bereavement leave without loss of regular compensation. Such leaves shall be limited to those for death in the immediate family (i.e. spouse, child, mother, father and siblings).
