248.04 DUTIES OF CHIEF.
   (a)   The Chief of Police is responsible for the management, administration and general supervision of the personnel, equipment, facilities and operations of the Police Department. He or she shall be accountable to the Village through the office of the Commissioner of Public Health and Safety and the Mayor. To this end, the Chief shall be strictly responsible for the general good order of the Department and attaining and retaining the maximum efficiency and effectiveness from the personnel, equipment and facilities assigned to him or her.
   (b)   The duties of the Chief include, but are not necessarily limited to, the following:
      (1)   Prescribing, promulgating and, with Council's approval, enforcing the policies and procedures, rules and regulations and general and special orders for the government of the members of the Department, so long as they are not inconsistent with the ordinances of the Village or the laws of the State. To this end, the Chief or his or her agent shall investigate charges brought against any member of the Department. The Chief may punish any such member found guilty of a violation of any of the rules and regulations, policies and procedures or written or verbal orders of the Department.
      (2)   Conferring with his or her subordinates for the purpose of giving instructions, so as to promote uniformity in the administration of the Department;
      (3)   Causing a general inspection to be made of all members of the Department at least twice a year and establishing such other systems of inspection and control as may be necessary to ensure the efficient administration of the Department;
      (4)   Preserving the public peace and enforcing the laws of the State and the Village of which the Department must take cognizance. Whenever a violation of such a law comes to his or her attention, the Chief or his or her designated agent shall cause the requisite complaint to be made and procure the evidence for the successful prosecution of the offender.
      (5)   Making all appointments and promotions in the Department, subject to the confirmation of Council;
      (6)   Keeping the Mayor, through the office of the Commissioner of Public Health and Safety, informed of any emergency, extraordinary action taken or necessary deviation from established Village policy or procedure;
      (7)   Keeping daily work records and personnel rating sheets and such other books and records as may be deemed necessary for the successful operation of the Department;
      (8)   Preparing and submitting to Council, on or before such annual date as may be designated by constituted authority, an estimate in detail of the cost and expense of providing for and maintaining the Department during the ensuing year;
      (9)   Delegating such powers as the Chief deems necessary for the efficient and effective administration of the Department, to be exercised by subordinates under his or her supervision, direction and control;
      (10)   Assigning functions, powers and duties to members of the Department; and
      (11)   Possessing and exercising all of the functions, powers and duties delegated to the Chief by State or Village law, which are necessary and proper to attain and retain an efficient and effective Department capable of protecting and serving the Village with the highest level of professionalism and integrity.
   (c)   Nothing in this section shall be construed as limiting the authority of the Chief to assign such functions or responsibilities as are necessary to establish and maintain maximum Departmental efficiency and effectiveness.
