The pool area shall be enclosed by a substantial protective barrier which shall be adequate and sufficient to prevent persons, children, or animals from danger or harm. The barrier shall be equipped with a self-closing, self-latching lock gate. All latches shall be placed 4 feet above the underlying ground or otherwise made inaccessible to small children from outside the pool area. The protective barrier may be:
(A) A chain link fence not less than 6 feet above ground level.
(B) A solid or a nonsolid fence not less than 6 feet in height above the ground level, which is found by the building commissioner to be so constructed that it will protect persons, children, or animals from danger or harm by entering the swimming pool area.
