§ 152.115 FEES, BONDS.
   To defray the engineering and inspection expenses incurred by the city in checking preliminary and final cost estimates, working drawings, specifications, and the final plat, and in executing inspection responsibilities, the subdivider shall be required to reimburse the city as follows. These are separate and distinct charges from the fee paid at the time of submission of the preliminary layout.
   (A)   The subdivider shall apply in writing to the city engineer, making a request that the working drawings, specifications, and estimates for improvements be checked. The application shall be accompanied by 2 sets of construction prints, specifications, and estimates. The city engineer shall inform the subdivider of the amount of the charge for this service, and the charge shall be based upon practices recommended by the Schedule of Recommended Fees for Engineering Services, published by the Illinois Society of Professional Engineers. Checking shall proceed after the subdivider has paid over this fee to the city clerk. Additional fees shall be paid for the rechecking of drawings, specifications, and estimates, arising from revisions made by or required of the subdivider. There shall be no refund of engineering fees if the project is abandoned for any reason whatsoever.
   (B)   The engineering fee is intended to include the preparation or checking of preliminary and final cost estimates, working drawings, specifications, and staking, but is not intended to include inspection.
   (C)   Before the grading or construction of improvements is started, the subdivider or his contractor shall post with the city clerk a cash inspection bond in an amount agreed upon between the city engineer and the subdivider or contractor as being sufficient to provide for inspection charges at the current per diem rates. Any excess of the bond over total inspection charges will be refunded to the depositor, and any overdraft on the bond shall be provided for immediately by the contractor, to ensure continuity of inspection. Payments to the city engineer for inspection services shall be made monthly in accordance with progress of the work.
   (D)   It shall be the responsibility of the subdivider or contractor to notify the city engineer in advance as to the dates that construction work will commence and complete for purposes of determining the number of days of the inspection charge. In the event of a dispute, only notification in writing shall be considered as proof of notice.
   (E)   Per diem inspection rates shall be equal to 100% of the engineer's quoted charge to the city. If the inspection is performed by an inspector on the city payroll, the charge shall be 135% of the regular salary paid to the inspector, computed on an hourly basis. There shall be not less than a 4-hour charge for time spent in any one day. For time spent outside of the regular working hours of the inspector, the hourly charge shall be 250% of the regular salary paid to the inspector, computed on an hourly basis.
