§ 150.44 REMEDYING DAMAGE TO PUBLIC PROPERTY.
   All damage and nuisance to and upon public property and public improvements, whether done with permission or without permission, shall be remedied as prescribed in this code and other ordinances of the city. Remedial action shall be with due regard for seasonal limitations and other weather conditions, and if the limitations preclude adherences to the time requirements of this section, the owner or his agent shall petition the mayor for an extension of the time requirements.
   (A)   Injured trees shall be replaced in kind immediately after completion of the construction work, or an alternative arrangement for replacing or compensation for the injured trees shall be made by agreement with the city.
   (B)   Sidewalks, curbs, and gutters damaged by vehicles, including tractors, shall be replaced within 10 days.
   (C)   Sidewalk, curb, and gutter breakage necessary to the installation of water and sewer connections shall be replaced within 30 days, and only after proper compaction of backfill.
   (D)   Pavement damage by vehicles, including tractors, shall be repaired within 10 days.
   (E)   Pavement breakage necessary to the installation of water, sewer, and other services shall be repaired within 30 days, and only after proper compaction of backfill.
   (F)   Backfill in roadways and alleys and under curb and gutter and sidewalk shall be compacted by tamping or puddling in incremental depths not to exceed 12 inches. The top 18 inches of backfill for the foregoing shall be 1/2 inch broken stone and the surface thereof shall be kept flush with adjoining pavement or sidewalk until the final pavement or sidewalk repair is made. Backfill in parkways shall be mounted from 4 to 8 inches, and the top 12 inches shall be black earth, and shall be sodded if the cut has been made in an established turf. No trench or excavation shall be left open more than 72 hours, and shall be barricaded and flared while open. The surface of backfill shall be maintained against settlement at least once every 7 days, and after each rainstorm.
   (G)   Dirt, sand, gravel, lumber, brick, cement, mortar, and other rubbish shall be removed from the streets, sidewalks, curb, gutter, and parkway immediately, unless express permission has been secured for storing construction materials upon public property.
   (H)   Clogged drain ditches and culverts shall be cleaned within 48 hours, and damaged culverts shall be replaced within 48 hours, except as may be hereinafter provided.
