Where damage or nuisance to public property or public improvements is accidental, inadvertent, or negligent, the owner or contractor causing the damage or nuisance shall immediately notify or cause his agent to immediately notify the building commissioner or his delegated representative of the damage or nuisance. In the absence of notification within 48 hours of the damage or nuisance, the damage or nuisance shall be deemed intentional.
