§ 97.13 DISPOSAL OF SYRINGES AND HYPODERMIC NEEDLES.
   (A)   Syringes and hypodermic needles shall not be placed in any outdoor refuse disposal container, or outside the container, unless the syringes and hypodermic needles are first broken, destroyed, and the remnants thereof placed in a sealed container. Any person, firm, or corporation causing or permitting the disposition of syringes and hypodermic needles in violation of this section shall be subject to a fine of not less than $50 and not more than $500.

   (B)   Any hospital may utilize, if it so chooses, in order to dispose of used syringes and hypodermic needles, a plastic, combustible container designed for the disposal of said syringes and hypodermic needles, approved by the Occupational Safety and Health Administration of the federal government, provided that all containers are destroyed on the premises of the hospital by the use of the hospital incinerator.
