A final determination of an automated traffic law violation liability shall occur under the following circumstances:
(A) Upon the failure to pay the penalty or request a hearing within 30 days, or after the hearing officer's determination of liability and the exhaustion of or failure to exhaust administrative review; or
(B) Where a person fails to appear at a hearing to contest the alleged violation in the time and manner specified, the hearing officer's determination shall become final upon the denial of a timely petition to set aside a determination, or upon the expiration of the time period for filing the petition without a filing having been made.
