§ 71.070 DRIVER AND PASSENGER REQUIRED TO USE SAFETY BELTS.
   (A)   The following words and phrases when uses in this section shall for the purposes of this section have the meanings ascribed to them in ILCS Ch. 625, Act 5, §§ 1 et seq: DRIVER, MOTOR VEHICLE, PASSENGER CAR, MOTOR- CYCLE, OPERATOR, or ROADWAY.
   (B)   Violations, exceptions, penalties, applicability.
      (1)   Each driver and passenger of a motor vehicle operated on a roadway in this city shall wear a properly adjusted and fastened seat belt; except that a child less than eight years of age shall be protected as required pursuant to the Illinois Child Passenger Protection Act (ILCS Ch.625, Act 25, §§ 1 et seq.). Each driver of a motor vehicle transporting a child eight years of age or more, but less than 16 years of age, in a motor vehicle shall secure the child in a properly adjusted and fastened seat belt.
      (2)   The provisions of this section shall not apply to any of the following:
         (a)   A driver or passenger frequently stopping and leaving the vehicle for roadway maintenance or roadway construction, if the speed of the vehicle between stops does not exceed 15 miles per hour.
         (b)   A driver or passenger possessing a written statement from a physician that such person is unable, for medical or physical reasons, to wear a safety belt.
         (c)   A driver or passenger possesses an official certificate or license endorsement issued by the appropriate agency in another state or county indicating that the drive or passenger is unable for medical, physical, or other valid reasons to wear a safety belt.
      (3)   In the event of violation of any provision of this section, the operator or a passenger motor vehicle shall be fined not less than $25 nor more than $100 for each person in the motor vehicle failing to use a safety belt as provided herein.
