§ 34.59 PERMIT REQUIRED; ALCOHOLIC BEVERAGES.
   (A)   Any organization or individual desiring exclusive use of a city recreational facility or park or a portion thereof shall make application therefor on a form approved by the City Council, obtainable from the Parks and Recreation Department. The application shall contain an agreement by the organization indemnifying the city from liability resulting from the organization’s/group’s use of the recreation facility or park. Permits shall be available upon such charges as may be determined from time to time by the Parks and Recreation Department, which charges may include the posting of a reasonable security deposit and rental fees.
   (B)   (1)   The cost of a per- day rental permit for use of the picnic shelter shall be:
         (a)   For residents          $25
            of the city
         (b)   For nonresidents      $100
            of the city
      (2)   The cost to rent a ball field for a period not to exceed four hours in length shall be:
         (a)   For residents          $15
            of the city
         (b)   For nonresidents      $50
            of the city
      (3)   The cost of the use of ball field lights shall be $25 per hour for all users.
      (4)   All persons that rent the picnic shelter or ball field shall also deposit the sum of $100 at the time the rental permit is issued to cover any damages.
   (C)   The deposit fee is for damages and is refundable on inspection if no damage has occurred.
   (D)   (1)   (a)   The City Council designates the Recreation Orchard Room as a permitted location for alcohol service and consumption in connection with rentals to be held at the facility, subject to the prior issuance of a permit for the event. Permits may be subject to such conditions as may, from time to time, be approved by the local Liquor Control Commissioner to promote and ensure compliance with all applicable ordinances of the city and laws of the state. Permit applicants shall be required to execute a written agreement accepting such conditions prior to the issuance of any permit. Permits shall be available upon such charge as may be determined from time to time by the Parks and Recreation Department, which charges may include the posting of a reasonable security deposit and purchase, through the city, liability insurance, naming the city as additional insured on the policy.
         (b)   In addition to any condition imposed from time to time by the local Liquor Control Commissioner on the service and consumption of alcoholic beverages in connection with permits for events at which such service and consumption is contemplated, the service and consumption of alcoholic beverages at such permitted events shall be subject to the following requirements at all listed city locations within this code:
            1.   No bottles or glass containers are permitted;
            2.   Alcohol must be served in plastic cups;
            3.   Only beer and wine are permitted to be served or consumed;
            4.   The sale of alcohol in exchange for any form of consideration is prohibited;
            5.   All applicable ordinances and laws must be followed;
            6.   Alcohol must be contained within the Orchard Room;
            7.   The required security deposit will be forfeited if the facility is damaged or not cleaned properly after the event; and
            8.   Posting of a reasonable security deposit and purchase of liability insurance, through the city, naming the City of Palos Heights as
additional insured on the policy.
         (c)   The city further designates the following city owned locations as eligible locations for the service and consumption of alcoholic beverages pursuant to a special event permit, subject to all applicable provisions of this chapter and this code, and further subject to the prior issuance of a permit by the city to use the location in question for the special event. Special event permits may be subject to such conditions as may be from time to time approved by the local Liquor Control Commissioner to promote and ensure compliance with all applicable ordinances of the city and laws of the state. Special event permit applications shall be required to execute a written agreement accepting such conditions prior to the issuance of the permit.
            1.    Recreation Center Orchard Room;
            2.   City Hall parking lot;
            3.    Community Park and Pavilion;
            4.   Meyers Park and Pavilion; and
            5.   Memorial Park and Gazebo.
         (d)   The city further designates the following city owned locations as locations from which the city or its authorized agents or contracted parties may serve alcoholic beverages in connection with events conducted by the city at such locations to invitees of the city for consumption:
            1.    Recreation Center Orchard Room;
            2.   City Hall parking lot;
            3.    Community Park and Pavilion;
            4.   Meyers Park and Pavilion; and
            5.   Memorial Park and Gazebo.
         (e)   All permits issued hereunder must be approved by the local Liquor License Commissioner prior to the event.
      (2)   Any person who violates the provisions of this division (D) shall be fined not less than $10 or more than $200 for each offense.
