§ 31.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   It shall be unlawful for any person to wear, carry or display any emblem of the offices of Emergency Services, Emergency Management, Homeland Security or Fire Department unless authority to do so has been granted to such person by the Marshal. Conviction for such violations of the provisions of this division (B)(1) shall be punishable by fine of not less than $300.
      (2)   It shall be unlawful for any person to violate any section of §§ 31.01 through 31.17 of this chapter, the Building Code, Health and Safety Code or the Fire Code (as adopted). Conviction for such violations is subject to a fine of:
         (a)   First offense: fine not less than $75, plus applicable court costs;
         (b)   Second offense: fine not less than $125, plus applicable court costs;
         (c)   Third offense: fine not less than $300, plus applicable court costs; and
         (d)   Subsequent offense: fine not less than $400, plus applicable court costs, plus applicable legal action as deemed necessary by the court.
      (3)   It shall be unlawful for any person to disregard a lawful order to evacuate an affected area or to disregard a lawful order to divert traffic or refuse to render aid to the Marshal or any person engaged in lawful duties under §§ 31.01 through 31.17 of this chapter. Conviction for such violation of §§ 31.01 through 31.17 of this chapter is subject to a fine not less than $400 and/or forceful removal from the affected area.
   (C)   Any person being convicted of any such misdemeanor, as set out in § 31.16 of this chapter, shall be fined in a sum not less than $100, nor more than $1,000; provided, however, that, any person so convicted shall have the right of appeal.
