§ 51.01 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning; provided that, to the extent that such definitions do not conflict with the defined or intended definitions in this chapter, the defined terms as provided for in the city zoning ordinance shall be used for the purposes of this chapter.
   APPROVED CONTAINER. Any dumpster or roll-off container being provided by the city or its contractor. Open-top roll-offs shall not be a substitute for bins or dumpsters unless approved by the Solid Waste Director or designee.
   BAGS. Plastic bags designed to store refuse with sufficient wall strength to maintain physical integrity when lifted by the top. Total weight of a bag and its contents shall not exceed 35 pounds.
   BIN. A high-density polyethylene (plastic) receptacle provided by the city or its contractor for the deposit and collection of waste designed to be lifted and emptied mechanically for use primarily at residential units including, if applicable, multi-family units.
   BRUSH. Hedge trimmings, tree limbs, branches and trimmings, plant and shrub trimmings, leaves, yard and grass cleanings and other similar items.
   BULKY WASTE. Refuse which due to size, weight or other reason is not capable of collection by the standard garbage or trash collection vehicle normally utilized by the city or its contractor to carry out that function, and includes but is not limited to stoves, washing machines, furniture and other heavy or bulky waste materials except construction debris, hazardous waste, household hazardous waste, or items containing freon.
   CONSTRUCTION DEBRIS. Waste building materials resulting from construction, remodeling, repair or demolition operations of any type of structure or building.
   CONTRACTOR. The person, corporation, partnership, or agent performing refuse collection and landfill operation under contract with the city.
   CUBIC YARD. A unit of garbage or trash having a measurement of one yard (three linear feet) in width, one yard (three linear feet) in depth, and occupying one cubic yard of space, regardless of density or degree of compaction of such garbage or trash in place.
   CUSTOMER. Any owner, occupant, tenant, itinerant vendor licensee, or person otherwise in possession or control of any premises in the city, or their agents, on which any material regulated by this chapter, including garbage, trash, and brush exist or are accumulated or from which such is removed or required to be removed pursuant to the terms of this chapter.
   DUMPSTER. A commercial type container provided by the city or its contractor for the deposit of garbage and/or trash.
   DUMPSTER REMOVAL. The removal from the premises of the dumpster.
   GARBAGE or TRASH. Interchangeably, anything discarded; any accumulation of waste that results from the use, preparation, processing, consumption, handling, packing, canning, storage, transportation, decay or decomposition of animal, vegetable, or other matter, or any refuse or rubbish, but does not include "bulky waste," "hazardous waste," "household hazardous wastes," "construction debris," dead animals, stable matter or "brush."
   HAZARDOUS WASTE. Any waste or combination of waste of a solid, liquid, contained gaseous, or semisolid form, which is identified by the Environmental Protection Agency (EPA) or any state agency as hazardous, and which exceed the threshold limits set forth by any such regulatory agency, or which because of its quantity, concentration or physical, chemical or infectious characteristics, may: (1) cause or significantly contribute to an increase in mortality or an increase in serious irreversible or incapacitating reversible illness; or (2) pose a substantial present or potential hazard to human health or the environment when improperly treated, stored, transported, disposed of, or otherwise managed. Such wastes include, but are not limited to, those which are toxic, corrosive, flammable, irritants, strong sensitizes, or which generate pressure through decomposition, heat or other means; or any chemical, compound, mixture, substance or chapter which is designated by the EPA or the Texas Commission on Environmental Quality (TCEQ) as "hazardous."
   HOUSEHOLD HAZARDOUS WASTE. Discarded products normally used at residences that are discarded in municipal solid waste and that contain substances already regulated under the Resource Conservation and Recovery Act of 1976 as an industrial hazardous waste.
   LAND CLEARING. The removal of trees, vegetation, soil or debris typically in the preparation of a tract of land for construction of structures or infrastructure.
   MULTI-FAMILY. Any residential unit other than a building on a single lot or parcel designed for and/or occupied exclusively by one family as a separate dwelling unit.
   NONRESIDENTIAL UNIT. Any unit or establishment within the corporate limits of the city intended to be used or occupied, or used or occupied, for other than residential purposes.
   RESIDENTIAL UNIT. A dwelling within the corporate limits of the City of Palmview intended for residential occupancy or occupied by any person for residential purposes, but not hotels, motels, boarding houses or other similar transient occupancies, except to the extent that separate kitchen facilities are provided.
   SERVICE. The picking up and removal of garbage or trash, regardless of density of compaction in place.
   UNIT. Each individual customer responsible for the payment of any fees or charges for any service rendered under this chapter.
   WASTE. Any substance or object whose producer or the person in possession of which discards, or intends to or is required to discard.
   WET SLOP. Waste in a liquid, semiliquid or liquescent form, such as, but not limited to sauces, broths, gravies, water used in a cooking process and grease.
