(A) Any person, firm, corporation or business entity that violates any provision of this chapter shall be guilty of a misdemeanor and, upon conviction, fined as provided in § 10.99 of the City of Palmview Code of Ordinances. Each day that the violation continues shall constitute a separate offense. A culpable mental state is not required to prove an offense under this chapter.
(B) The penal provisions imposed by this chapter shall not preclude the city from filing a suit to enjoin the violation. The city retains all legal rights and remedies available to it pursuant to local, state and federal law. The city may, at its discretion, report alleged noncompliance to the EPA, the TCEQ, U.S. Fish and Wildlife Service, Texas Parks and Wildlife, the U.S. Army Corps of Engineers, or any other state or federal agency.
