(A) (1) A fireworks permit holder can sell fireworks only to the public and only during the following periods:
(a) Beginning June 24 and ending at midnight on July 4; and
(b) Beginning December 20 and ending at midnight on January 1 of the following year.
(2) Fireworks cannot not be sold or offered for sale to children less than 16 years of age or to an intoxicated or incompetent person. A person selling fireworks shall make a reasonable effort to determine that potential purchasers of fireworks are of the minimum age as required by this section.
(3) A person shall pay a non-refundable fee in the amount of $200 for the fireworks permit.
(B) A fireworks permit is required for each fireworks stand.
(1) A permit holder must purchase fireworks 1.4G only from a distributor or jobber licensed in the state.
(2) Fireworks 1.4G can be sold to the general public only at legally permitted fireworks site and during the legal selling periods defined in this section.
(3) Prior to the issuance of a fireworks permit, the applicant must present evidence of a valid current sales tax permit issued by the State Comptroller and the sales tax permit number must be entered on the fireworks stand permit by the person issuing the permit.
(4) A fireworks permit can only be issued to individuals or groups engaged in the retail sales of fireworks or to wholesalers as described in this section.
