§ 70.21 TRAVERSING INUNDATED STREETS WITH VEHICLE.
   (A)   Traversing inundated street prohibited.
      (1)   It shall be unlawful for any person to traverse an inundated street in an automobile, truck, boat, or other vehicle or vessel at such speed as to create a wake therein that causes damage or increased flooding to the property or premises adjoining such inundated street or streets.
      (2)   It shall be a defense to prosecution under this section that the vehicle being operated or driven was at the time in question an authorized emergency vehicle or other city vehicle performing an authorized governmental function.
      (3)   Inundated shall mean a street with water to the extent that water covers the top of the curb on both sides of the street.
   (B)   Penalty for violation of section. A person who violates any provision of this section shall be guilty of a Class C misdemeanor and upon conviction shall be fined an amount not exceeding $500.
   (C)   City of Palm Valley authority. In the event that it is declared that the streets of the City of Palm Valley, Texas are inundated, the Mayor, Police Chief and/or Public Works Supervisor shall have the authority to close some or all of the streets of the City of Palm Valley by use of barricades, warning signs or other similar method. For purposes of enforcement, the definition of barricades and warning signs as used in this division is the same as used in Tex. Transportation Code § 472.002.
