(A) Regulations governing the height and locations of fences apply to hedges or landscaping used in lieu of a fence or in combination with a fence. A fence is any part of a fence including the base, footings and supporting columns, posts, braces, structural members, or any other appendages.
(B) The total fence height including posts or any other attachments may not exceed six feet measured to the ground on both sides along the length of said fence except as provided elsewhere. Decorative gate embellishments are allowed. They shall not exceed the height of the fence by more than two feet. Notwithstanding the foregoing, the total fence height including posts or any other attachments such as decorative embellishments for fences located, placed, or constructed along the exterior boundary of the City of Palm Valley, save and expect for the exterior boundaries located along Wilson Road and Stuart Place Road, shall not exceed eight feet measured to the ground on both sides along the length of said fence.
(C) The fence may contain a base wall which must be constructed of face brick or of masonry material covered with stucco that is attached and is compatible with the dwelling or building to which it is appurtenant in terms of its design and material composition, and may not exceed two feet in height.
(D) No fence shall be constructed within any drainage easements unless an engineer shall have first determined and advised the Building Inspector, in writing, that he believes such fence shall, in all probability, not interfere with or impair the natural flow of water across the drainage easement.
(E) Wooden fences must meet the following standards:
(1) All vertical posts must be 4x4 treated wood, cedar or (16) gauge galvanized steel spaced at a maximum of eight feet on center set two feet deep in a concrete footing.
(2) All pickets shall be a minimum of 1/2" in thickness.
(3) Wood material shall be an insect resistant wood such as cedar or pressure treated yellow pine.
(4) The fence shall have its backside (the side with exposed post or rails) oriented away from view from the streets in Palm Valley.
(5) All materials shall be securely fastened, vertical boards to horizontal stringers, stringers to vertical post, or rail to ensure an ongoing attractive appearance and safe condition, free from rot, rust, vandalism, and other sources of decay.
(6) A gate is required. Every fence enclosure constructed shall have a least one gate in its perimeter a minimum of three feet in width. Properties that border Dilworth Road or the alleyway of Country Club Estates shall have a gate on the rear fences.
(7) Decorative gates. Subject to the restriction that a fence may not extend past the front of each side of the house, a decorative gate of no more than eight feet in height in the front yard may be utilized as long as it allows minimum 50% opacity.
(F) Notwithstanding any provision to the contrary contained within the ordinances of the town, fences erected in compliance with this section may be built on the side or common property line with the following setback requirements.
(1) Fences on golf course lots. On lots abutting the golf course, no fence or wall, hedge may be built nearer the rear lot line abutting the golf course than the building set back line therefrom. The set back line is contained in the property's deed restrictions.
(G) A fence permit must be obtained from the Building Inspector prior to installation. It shall be unlawful for any person to install or cause to be installed, or to permit any person to install a fence, or to make any alterations, additions or changes to a fence, without first having procured a permit to do so from the Building Inspector. No fence or wall may be built on any location prior to submitting a detailed drawing to the City Secretary for written approval by the city's Building Inspector. An inspection of the finished installation by the Building Inspector shall be required.
(H) No fence may extend past the front wall of each side of the house.
(I) Any fence that is constructed or erected to comply with the requirements of the Standard Swimming Pool Code shall comply with both the requirements of said code and this chapter.
(J) No person shall build and/or maintain any fence composed, in whole or in part, of:
(1) Chain link fencing material
(2) Barbed wire or razor wire welded or woven wire such as chicken wire, hog wire, stockade panels and similar agricultural wires.
(3) Electric fences.
(4) Galvanized sheet metal, corrugated metal, or corrugated fiberglass.
(5) Materials not approved for exterior exposure.
(6) Used materials.
