§ 154.042 EXCEPTIONS.
   (A)   If any tree shall endanger health, safety or property and require immediate removal without delay, verbal authorization may be given by the enforcement official and the tree removed. The verbal authorization shall later be confirmed in writing by the town.
   (B)   All state-approved and governmental plant or tree nurseries and botanical gardens shall be exempt from the terms and provisions of this chapter but only in relation to those trees planted and growing for the sale or intended sale to the general public.
   (C)   Pruning of red mangroves shall be specifically prohibited except as otherwise provided in this chapter.
   (D)   The pruning of white and black mangroves may be permitted up to 30% of the canopy. All pruning of mangroves must follow specified guidelines set forth in the ordinances of the town. The following standards shall apply:
      (1)   Selective pruning of limbs one inch in diameter or less is permitted;
      (2)   No tree under six inches in height may be pruned; and
      (3)   No alteration may be made to meumatophores or trunk.
