§ 154.024 PERFORMANCE BOND; SURETY.
   (A)   Where the applicant requests and the enforcement official determines that it would not be prudent to require the planting of trees prior to the issuance of a subdivision certificate of completion or certificate of occupancy, such as when it is an improper time of year for planting trees, or there is a need to root prune the trees, or to comply with other provisions of this chapter, a performance bond or other surety, in a form acceptable to the Town Council, must be posted by the applicant.
   (B)   A performance bond or other form of acceptable surety, if posted, shall be for 125% of the estimated cost of the purchase and installation of all trees and palms to be planted or relocated. The bond or surety shall be posted prior to the issuance of the certificate of completion or certificate of occupancy and shall extend until a time as the enforcement official has accepted the planting.
