§ 91.085 ABANDONED PROPERTY TO BE SOLD AT AUCTION; NOTICE OF AUCTION.
   All property abandoned on public or private lands which has been removed by the town as set forth in the subchapter shall be disposed of in the following manner:
   (A)   If the residence or address of the owner or any person holding a lien upon the property cannot be ascertained, or if the owner or person holding a lien upon the property fails to take possession of the property within 60 days after the mailing of a notice provided for in this section, the property shall be sold at public auction by the town at some place within the town limits; and
   (B)   Prior to the sale, a notice shall be published in some newspaper, published in the town, publication to be at least 70 days prior to the date of the sale. The publication shall give the time and place of sale and description of the property to be sold. A copy of the notice shall be mailed to the owner and each person holding a lien on the property, if the address of the person is known. The notice shall be mailed 70 days prior to the date of the sale.
