Notwithstanding any other section of this subchapter, any user found to have violated any provision of this subchapter, permits and orders issued hereunder, or any other pretreatment requirement shall be fined in an amount not to exceed the maximum of two hundred fifty dollars ($250.00) per day. In the case of monthly or other long term average discharge limits, fines shall be assessed for each business day during the period of violation.
(A) Unpaid charges, after thirty (30) calendar days, shall be liened against the property in accordance with Chapter 118 of the Code of Ordinances.
(B) Where appropriate, the City Manager may accept mitigation projects in lieu of the payment of all or a part of any civil penalties where the project provides a valuable service to the City of Palm Bay and the violator's expense in undertaking the project is at least one hundred fifty percent (150%) of the civil penalty.
