The City Manager shall be appointed by the City Council. He or she shall be chosen solely on the basis of his or her executive and administrative qualifications with special reference to his or her actual experience in, or his or her knowledge of, accepted practice in respect to the duties of his or her office hereinafter set forth.
(A) Appointment. At the time of his or her appointment, the City Manager need not be a resident of the city or the state. However should the Manager change residency subsequent to his or her appointment, the Manager shall reside within the city during his or her tenure of office.
(B) Removal. The Council may remove the City Manager, with or without cause, at any time by a majority vote of the entire Council, by adopting a resolution to that effect. The City Manager may, within ten (10) days after notice of adoption of such resolution, reply in writing, and may request a public hearing which shall be held not earlier than twenty (20) days, nor later than thirty (30) days, after the filing of such request. The action of the Council in removing the City Manager shall be final.
(C) Compensation. The compensation of the City Manager shall be fixed by the Council budget or by contract, which amount shall be reflected in the budget.
(D) Performance evaluation. The Council shall review and evaluate the performance of the City Manager at least once annually on his or her anniversary date. The review and evaluation shall be in accordance with specific criteria developed by the Council and may be revised as the Council may from time to time determine. The evaluation shall also serve as a basis for determining merit increases to the City Manager's base salary.
