§ 50.15 VACANCY IN CANDIDACY.
   (A)   The qualifying fee shall not be returned if a death should occur to a qualified candidate or a qualified candidate withdraws prior to the end of the qualifying period.
   (B)   Vacancies occurring in candidacy after the qualifying period due to death, withdrawal, or removal from the ballot shall be treated as follows:
      (1)   If a death should occur to a candidate or a candidate's name is removed from the ballot through legal procedures or a candidate withdraws and there is not sufficient time to allow for the removal of the name from the ballot, a vote cast for that candidate shall not be canvassed or certified as a valid vote.
      (2)   If the death, withdrawal, or removal from the ballot of a candidate leaves only one (1) candidate qualified for the office, the remaining candidate shall, in the absence of a write-in candidate for that office, be declared elected, and no election for that office shall be required. The qualified candidate's name shall not be printed on the ballot.
         (a)   If there is not sufficient time to allow for the removal of the name from the ballot, a vote cast for that candidate shall not be canvassed or certified as a valid vote.
      (3)   There shall be no refund of the qualifying fee.
