§ 150.15  APPROVAL OF UTILITY COMMISSION PRIOR TO EXCAVATION; ISSUANCE OF PERMIT.
   (A)   Prior to the granting of a building permit by the city, the permit applicant must receive from the Utilities Commission a written authorization to proceed before any excavation is done on any property located within the city limits.  The Building Inspector shall not issue a permit until such written authorization is received by him from the Utilities Commission.
   (B)   In the event that the construction or excavation requires the relocation of service lines of the Utilities Commission, the permit applicant shall be responsible for any relocation costs and in the event that a fill is required for the building site, the permit applicant shall be responsible for relocation or permit applicant may request the Utilities Commission to forego any relocation by guaranteeing to the Utilities Commission that they would be responsible for any future problems associated with filling over and placing a service line below normal ground level.
   (C)   The Utilities Commission shall grant a decision to the permit applicant within 15 days of the application.
   (D)   This section shall apply to both excavation as well as filling of property located within the city limits.
