§ 38.40  USE OF AND INTERFERENCE WITH RADIO FREQUENCIES PROHIBITED.
   (A)   It shall be unlawful for any person, firm, corporation or business association to use, interfere with, or install a program in any radio frequency licensed, assigned to or authorized for the use of any city department by the Federal Communications Commission, without written approval by the city.
   (B)   Any person violating the provisions of this section, the regulations issued thereunder or any order issued thereunder, or who knowingly induces another, directly or indirectly, to violate the provisions of this section shall be guilty of a misdemeanor and shall be fined not more than $500 or imprisoned for not more than one year, or both. Each day's continued violation shall constitute a separate offense.
