917.05 POPLAR, COTTONWOOD, ASPEN OR WILLOW TREES PROHIBITED.
   (a)   No person shall plant or set out any tree of the variety commonly known as Poplar, Cottonwood, Aspen or Willow within the limits of the City.
   (b)   Notwithstanding subsection (a) hereof, upon application, and as approved by the City Manager, certain male hybrid Cottonwoods, certified by a nursery to be debris free, may be planted for screening purposes.
   (c)   Any person who is the owner of any premises, lot or land on which any tree that is located within fifty feet of any storm or sanitary sewer that has been determined to be hazardous to such storm or sanitary sewer shall cause the tree to be removed within thirty days after written notice is received to remove such tree or trees.
   (d)   If the owner neglects to remove such tree or trees as specified herein within thirty days after receiving written notice to do so, the City Manager shall cause the same to be removed and charge the expense against the property owner, and if the property owner fails to pay the same within thirty days after notice of the amount of the expense, the Finance Director shall certify the same to the Lake County Auditor to be placed upon the tax duplicate and collected as other taxes are collected according to law.
