167.30 OVERTIME WORK.
   (a)   Overtime Administration. In any emergency, a department head may prescribe, with the approval of the City Manager, reasonable periods of overtime work to meet operational needs. Such overtime shall be reported and justified as required by the City Manager.
   (b)   Overtime Pay.
      (1)   Employees paid on an hourly-rated basis shall be paid at one and one-half times their regular hourly rate for any hours worked beyond forty hours per week or eight hours per day, when authorized in accordance with subsection (a) hereof.
      (2)   Salary-rated employees paid in Class Grade 18 or below, who are eligible for overtime pay shall be paid at one and one-half times their regular hourly rate as defined in the Compensation Schedules of the City for any hours worked beyond forty hours per week or eight hours per day, when authorized in accordance with subsection (a) hereof.
   Union employees, refer to your Collective Bargaining Agreement, Article XIII, Overtime and Pay Types; Dispatchers, Article 14, Overtime and Premium Pay.
   (c)   Overtime Compensation for Salaried Employees in Class Grade 19 or Above. Salaried employees in the Administration Class (department/division heads and senior supervisors) shall not be eligible for overtime compensation, but may be granted compensatory time off by the City Manager in exceptional cases and when conditions permit.
   (d)   Overtime Pay for Meetings Beyond Regular Working Hours. Salary-rated employees in Class Grade 18 or below shall be paid at their established overtime rates for time spent beyond regular working hours at staff or planning meetings called by the City Manager or the responsible department head, or at meetings of all agencies, boards or commissions when called by the presiding officer thereto, when authorized in accordance with subsection (a) hereof.
   (e)   Determining Hours Worked for Overtime Qualification. For the purposes of determining hours worked to qualify for the overtime payment calculation, the following shall apply:
      (1)   Work week schedule. The normal work week schedule shall not be the determinate, rather it is when the employee goes beyond forty hours in a week. (For these purposes there shall be no duplicating, pyramiding or doubling of hours.)
      (2)   Holidays. A holiday shall be considered a day worked for purposes of determining eligibility for overtime hours worked beyond forty hours per week. Pay for overtime hours worked and/or work on a holiday shall not be duplicated, pyramided or counted again for the purpose of computing overtime pay.
      (3)   Vacation. Vacation time shall be considered as time worked for purposes of determining eligibility for overtime pay for hours worked beyond forty hours per week. Pay for overtime hours worked and/or work on a vacation day shall not be duplicated, pyramided or counted again for purposes of computing overtime pay.
      (4)   Sick leave. Sick leave hours taken shall be considered as time worked for the purpose of determining eligibility for overtime pay hours worked beyond forty hours per week. These hours, as well as hours in subsection (e)(3) hereof, may only be considered if they occur within the body of the work week and in no instance can they be used for this purpose on the "tail end" of any week, or paid at an overtime rate for time spent away from work.
      (5)   Absence. Any other absence not provided for above shall not be construed as time worked for purposes of determining eligibility for overtime pay hours worked beyond forty hours per week.
