(a) No television wires and cables shall be constructed across public streets or sidewalks within the Municipality until the permit for such construction has been issued by the Recorder.
(b) All television wires and cables crossing public streets or sidewalks shall be constructed at least two feet under all existing electrical power lines. All of such wires and cables shall be installed in accordance with the requirements of the 1987 National Electrical Code.
(c) Any applicant seeking permission to construct or extend television wires or cables across and over any part of a public street or sidewalk shall, at the time of making such application, furnish the Recorder with an insurance policy insuring the Municipality against loss resulting from the injury to the person or property of persons resulting from granting of the permission here considered, with limits in the amount of twenty-five thousand dollars ($25,000) for injury to a single person and fifty thousand dollars for. injury to two or more persons and with limits in the amount of ten thousand dollars ($10,000) for injury to the property of a single person and twenty thousand dollars ($20,000) for injury to the property of two or more persons. The liability insurance policy to be delivered to the Recorder by the applicant as a condition precedent to the granting of the permit to cross a public street or sidewalk shall further be accompanied by a letter from the insurance agent representing the company issuing the policy, advising the Municipality that he will notify the Municipality in writing of any cancellation of such insurance policy or that the same results from the voluntary act of the purchaser of the policy or as the result of nonpayment of the premiums for such policy by the purchaser or for any other reason. Such letter from such insurance agent shall further provide that the written notification here provided for shall be addressed to the Recorder.
(d) The Public Works Superintendent and Building and Safety Inspector are empowered to inspect or reinspect any television wires and cables crossing public streets or sidewalks in the Municipality, and if such wires and cables are found to be unsafe or found not to have been installed in accordance with the requirements of the 1987 National Electrical Code, the Recorder shall notify the person, firm or corporation owning such wires and cables. to correct the condition within a time specified by them. If the owner of such wires and cables fail to correct such unsafe condition within the time specified by them, they may, in this event, remove or cause such wires and cables crossing Municipal streets or sidewalks to be removed. Failure of the owner of such wires or cables to correct violations of this section within the time specified by the Recorder shall constitute an offense punishable by fine not exceeding twenty-five dollars ($25.00).
(e) The provisions of this section shall not apply to commercial broadcasting and other commercial transmitting stations.
