(a) The office of the Building and Safety Inspector is hereby created. Until such time as Council may provide for the appointment of the Fire Chief or a qualified person to devote his part time to the duties of such office, the Mayor, with the approval of Council, shall designate an appropriate officer or officers as ex officio Building and Safety Inspector. The Building and Safety Inspector shall have the powers and perform the duties of such office as provided by State law, the Codified Ordinances and/or other ordinances or by resolution of Council. The Building and Safety Inspector will be compensated at a rate to be determined by Council.
(b) At any time during the tenure of any building project contemplated by this chapter, the Building and Safety Inspector shall have the right to enter upon the premises of such project in order to determine whether the requirements prescribed in the National Fire Code and the West Virginia Fire Code are being observed. If, in the opinion of the Building and Safety Inspector, the holder of the building permit is not operating in conformity with such code requirements, the Inspector shall have the right to withdraw the building permit from the holder thereof and thereby order the project terminated until such time as the identified violations shall have been corrected.
(c) In the event that any person shall begin work for which a building permit is required without benefit of such permit or in the event the person from whom such building permit shall have been withdrawn shall continue building operations notwithstanding withdrawal of his building permit, such fact shall be immediately reported to Council, which shall cause the offender to be fined in the amount of one hundred dollars ($100.00) per day for each day such person shall
continue operations without the benefit of a building permit.
