Such assessments for the whole or fraction of a year shall become due monthly, and if not paid by the tenth of each month, such user shall be subject to a penalty of ten percent (10%) for each month or fraction thereof, that the same shall remain unpaid. For just cause, Council shall and for the excusable neglect may, upon application in writing of any person affected thereof, remit any penalty in whole or in part.
