Whenever the owner of any sidewalk, or of the real property next adjacent thereto, shall fail or refuse to pave the same in front of such property in the manner and within the time required by Council, it shall be the duty of the Mayor to cause the sidewalk to be paved upon the most reasonable terms and to furnish and file with the Recorder a correct account containing a statement of the expenses incurred. Thereupon, Council shall assess the amount of such expense upon the owner or occupant of such property, and require the same to be collected in the manner required by law for the collection of Town taxes, or the same may be collected by a civil proceedings against the owner of such property.
