533.14 BONFIRES AND OUTDOOR FIRES; REGULATIONS AND RESTRICTIONS; SUPERVISION REQUIRED; PENALTIES.
   (a)   No person shall kindle or maintain any bonfire or rubbish fire or authorize such fire to be kindled or maintained on or in a public street, alley, road, park or other public ground without a permit or other proper authorization. During the construction or demolition of buildings or structures, no waste materials or rubbish shall be disposed of by burning on the premises or in the immediate vicinity without having obtaining a permit or other proper authorization.
   (b)   No person shall kindle or maintain any bonfire or rubbish fire or authorize any such fire to be kindled or maintained on any private land unless:
      (1)   The location is not less than 50 feet from any structure and adequate provision is made to prevent fire from spreading to within 50 feet of any structure; or,
      (2)   The fire is contained in an approved waste burner located safely not less than 15 feet from any structure; and,
      (3)   The authority to kindle or maintain such fire has been obtained from the Chief of the Fire Department or his authorized agent.
   (c)   The Council shall set the burning periods for the Chief of the Fire Department or his authorized agent to issue burning permits.
   The guidelines for burning material shall be:
      (1)   No tires or other rubber, plastic, or asphaltic material or construction/demolition debris are to be burned.
      (2)   No leaves shall be burned unless attached to tree limbs.
      (3)   No trunks, limbs, stumps, etc. over five (5) inches in diameter are to be burned.
      (4)   Vegetation to be burned shall be well dried, a minimum of ten (10 days, and piled so as to promote combustion.
      (5)   No roofing or overstuffed furniture.
      (6)   Burning of a structure shall be utilized for bona fide fire training purpose, not merely for disposal of the structure.
   (d)   After proper permission is obtained, bonfires and rubbish fires shall be constantly attended by a competent person until such fire is extinguished. This person shall have a garden hose connected to the water supply, or other fire extinguishing equipment readily available for use.
   (e)   A person shall at any time be permitted to kindle or maintain a fire for cooking purposes.
   (f)   The definition of a fire for cooking shall be ring fireplace no wider than thirty (30) inches in diameter that will not produce any flames higher than thirty-six (36) inches, any stationary grill, a mobile grill or an outside fixed fireplace.
   (g)   The Mayor and/or the Chief of the Fire Department may prohibit any and all bonfires and outdoor rubbish fires when atmospheric conditions or local circumstances make such fire hazardous.
   (h)   Violators hereof shall, upon conviction, be subject to a fine not less than $10.00 nor more than $50.00.
