171.12 COSTS; COLLECTION OF FINES, COSTS AND FEES.
   (a)   The City shall be entitled to and the Municipal Court Judge may tax, in all cases appearing before him involving violations of City ordinances, the same costs, fees and allowances and in the same amounts as a magistrate may tax.

   (b)   The Municipal Court Judge shall tax, in all cases appearing before him involving violations of City ordinances, the following costs:
      (1)   Municipal court costs of twenty dollars ($20.00).
      (2)   West Virginia law enforcement training fund cost of two dollars ($2.00).
      (3)   West Virginia crime victims reparation fund cost of eight dollars ($8.00).
      (4)   West Virginia regional jail and prison development fund cost of forty-two dollars ($42.00); provided, however, that such cost shall not be assessed for a traffic offense that is not a moving violation or an offense for which the ordinance violated does not provide for a period of incarceration; and further provided, that of such cost, two dollars ($2.00) shall be an administrative cost retained by the City.
      (5)   A Community Corrections Act - Public Safety. $10.00 assessed against any defendant convicted.

      (6)   Reinstatement Fee - Driver License. A fee of fifty dollars ($50.00) is hereby imposed upon any person whose driver’s license or privilege to operate a motor vehicle in this State is reinstated after having been suspended for any of the following:
         A.   Failure to timely pay costs, fines, forfeitures or penalties imposed by the Municipal Court;
         B.   Default on a payment plan for such costs, fines, forfeitures or penalties; or
         C.   Failure to appear or otherwise respond in court when charged with a municipal violation, all as provided for by the West Virginia Code.
   The fee imposed by this section shall be paid prior to the person’s driver’s license or privilege to drive is reinstated by the State Division of Motor Vehicles. Such fee is imposed to defer the costs to the City associated with administrative expenses related to the suspension and reinstatement.

      (7)   The City shall collect a $35 fee for copies of accident reports and criminal complaints. (Ord. 2015-13. Passed 8-13-15.)
      (8)   The City shall collect a $10 fee for fingerprinting.

      (9)   A $20.00 court cost will be added to be used specifically for equipment for the Police Department. The court cost will be put in a separate account for the Police Department and the Chief and the Police Committee will bring recommendations to Council for approval as to how the monies will be allocated for purchases.
