4-3-2: DEFINITIONS:
For the purpose of this chapter, the following terms shall have the meanings ascribed to them in this section:
APPLIANCES: Machines common to residential household use, and includes refrigerators, stoves, microwave ovens, dishwashers, clothes washers, clothes dryers, water heaters, furnaces, air conditioners, dehumidifiers, console television sets, stereo systems, lawn mowers; and any device containing a gasoline engine, an electric motor, or electric capacitor.
BUILDING DEMOLITION MATERIALS: Waste material from the construction, destruction, or demolition of residential, commercial, or industrial buildings or structures including brick and foundation materials.
BULKY RUBBISH: Nonputrescible refuse consisting of combustible and/or noncombustible waste materials which are either too large or too heavy to be safely and conveniently loaded into solid waste transportation vehicles by solid waste collectors.
CITY: The city of Oxford, Iowa, or its designated agent, including any hauler operating under contract with the city of Oxford, Iowa.
COMMERCIAL SOLID WASTE: Solid waste resulting from the operation of any commercial, industrial, institutional, agricultural, or other establishment.
DEMOLITION: Substantial destruction of a building or structure, and substantial removal of the interior of a building or structure.
DISPOSABLE SOLID WASTE CONTAINER: Disposal plastic, or paper sacks specifically designed for storage of solid waste.
DWELLING: A building which is wholly or partially used or intended to be used for residential occupancy. No dwelling may contain more than four (4) dwelling units to qualify for residential solid waste pick up.
DWELLING UNIT: Any habitable room or group of adjoining habitable rooms located within a dwelling and forming a single unit possessing facilities which are used, or intended to be used, for living, sleeping, cooking, and eating of meals.
GARBAGE: Putrescible animal or vegetable wastes resulting from the handling, preparation, cooking, serving, or consumption of food.
HAULER: Any designated business enterprise engaged by contract with the city for the purpose of collecting and disposing of waste materials as defined by this chapter.
HAZARDOUS WASTE: Includes, but is not limited to, pathological waste, explosive waste, pesticides, containers, toxic radioactive materials, and those wastes included by definition in Iowa Code section 455B.411(3a) and rules of Iowa department of natural resources.
OCCUPANT: Any person who alone, or jointly or severally with others, shall be in actual possession of any dwelling unit or any other improved or other unimproved real property, or either as owner, landlord, tenant, resident or operator.
OPERATOR: Any user, responsible party, occupant, entity, business, firm, corporation, governmental entity, association, partnership, venture, or any combination thereof, or any agent, fiduciary, or representative thereof, who occupies, possesses, uses, or owns property within the city of Oxford, Iowa, and/or who stores or generates solid waste within Oxford, Iowa.
OWNER: Any recognized interest of ownership in real or personal property, including legal and equitable property interest.
PERSON: Individual person, user, responsible party, entity, business, firm, corporation, partnership, venture, or any combination thereof, or any agent, representative, or fiduciary thereof.
PREMISES: Includes any interest in real property, including, but not limited to, buildings and improvements, whether intended for or used for residential, commercial, or industrial use.
REFUSE: Solid waste not required to be recycled or reused.
RESIDENTIAL SOLID WASTE: Solid waste resulting from the maintenance and operation of a dwelling.
RESPONSIBLE PARTY: Any person, persons, or governmental entity, who applies for, who obtains, or who is issued an account for solid waste service, and includes any person who pays an individual account for solid waste collection service. "Responsible party" shall also mean an account holder of the above account. If more than one person is listed on an account, both persons shall be deemed "responsible party" for purposes of this chapter.
SOLID WASTE: Unwanted or discarded waste materials in a solid or semisolid state, including, but not limited to, garbage and refuse.
SOLID WASTE CONTAINER: A receptacle used by a person to store solid waste during the interval between solid waste collections.
STORAGE: Keeping, maintaining, or storing solid waste from the time of its production until the time of its collection and removal.
TRANSPORTATION: The transporting of solid waste from the place of collection or processing to the city of Oxford's disposal site.
YARD WASTE: Grass, leaves, trees, brush, and garden residue. (Ord. 1990-86, 6-13-1990; amd. 2015 Code)
