6-4-6: AUCTION OF OPERABLE VEHICLE:
   A.   Sale To Highest Bidder: If an abandoned motor vehicle which has not been reclaimed as provided by section 6-4-4 of this chapter, it shall be sold at public auction to the highest bidder.
   B.   Publication Of Notice: Notice of auction shall be published in a newspaper of general circulation in the city at least seven (7) days and no more than fourteen (14) days prior to the auction.
   C.   Sale For Use On Highways; Inspection: Before the auction, the mayor or other peace officer designated by the city council shall make a determination as to whether or not the vehicle should be sold for use upon the highways. If it is to be sold for such use, it shall first be inspected as required by law, have a valid certificate of inspection affixed, and shall then be sold, and title given in accordance with law.
   D.   Vehicles Not Sold For Use On Highways: Vehicles not sold for use upon the highways shall be sold only in accordance with the restrictions in the state law. The purchaser shall take title as provided for by law, or if sold to a demolisher, no further titling of the motor vehicle shall be permitted.
   E.   Disposition Of Proceeds: Proceeds of any sale shall apply to the costs of towing, preserving, storing and notification required, in accordance with state law, and any balance shall be disposed of as required by law. (Ord. 83-71, 2-10-1983)
