§ 90.02 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ALARM SYSTEM. Any type of an assembly of equipment and devices or a single device arranged to signal the presence of a hazard requiring urgent attention and to which Police or Fire Department personnel are expected to respond. This includes any type of burglar alarm, fire alarm or holdup alarm and automatic telephone dialer alarms, except this does not include smoke detectors or other alarms which do not signal outside the alarmed premises, or alarm systems on motor vehicles.
   ALARM USER. Any person, firm, corporation or any legal entity whatsoever on whose premises any alarm system is maintained within the town.
   AUTOMATIC DEVICE. Any alarm system which automatically sends, by direct connection or otherwise, any message or notice indicating the existence of an emergency situation that the alarm system is designed to detect.
   FALSE ALARM. The activation of an alarm system through mechanical failure, malfunction, improper installation or the negligence of the owner or lessee of an alarm system or of his, her or its employees, agents or servants. Exemptions to this may include, but are not limited to, weather conditions that may activate the alarm. A burglar alarm activated without a crime committed or a false fire alarm without evidence of a fire is the basis for any violation found as hereinafter set forth. Excluded from this chapter are FALSE ALARMS that are transmitted with a criminal, malicious or mischievous intent. These violations will be prosecuted under the applicable General Statutes of the state.
   FINING AUTHORITY. Refers either to the Town Fire Department if a fire alarm or the like is activated as hereinabove defined or Town Police Department or any sworn state police officer, if a burglar alarm is activated as hereinabove set forth.
