§ 51.02 RECYCLABLE ITEMS.
   (A)   Each person who generates, maintains, stores or accumulates solid waste within the town shall separate all recyclable items from all other types of solid waste and shall effectuate collection or removal of recyclable items in the manner hereinafter set forth.
   (B)   In the event that recyclable items are commingled with other types of solid waste neither the recyclable items nor the other types of solid waste shall be collected by any municipally registered hauler or other solid waste collector nor accepted for disposal at the municipal recycling center or any other refuse processing facility.
   (C)   Each person shall deliver recyclable items directly to the municipal recycling center or, in the alternative, shall contract with a municipally registered hauler for disposal of recyclable items at the municipal recycling center or at other locations as may be approved, in advance, by the Board of Selectmen. The owner of any multi-family dwelling, shopping center, industrial park, institutional establishment or other property or facility servicing more than one person or family, shall be ultimately responsible for compliance with this chapter. The owner may contract directly with a municipally registered hauler to ensure compliance with this chapter. With respect to a condominium complex, the condominium association shall be responsible for full compliance.
   (D)   Recyclable items collected by a municipally registered hauler shall be prepared in the manner designated by the municipally registered hauler. Recyclable items delivered to the municipal recycling center shall be prepared in compliance with any notice or notices posted at the municipal recycling center.
   (E)   Recyclable items shall not be placed for collection, stocked, stored or otherwise accumulated in a manner or for a duration which constitutes a public nuisance, private nuisance or violation of a health code or other law.
   (F)   Recyclable items shall not be deposited or dumped within the town at any location other than the municipal recycling center or other site approved by the Board of Selectmen. Recyclable items which are generated and/or separated at a source outside of the town shall not be deposited at the municipal recycling center or at any other location within the town without approval of the Board of Selectmen.
