(A) Application. All solid waste collectors shall make application to the Director in the manner designated by the Director for a license to collect, transport and/or dispose of solid waste in the town, and shall provide the Director with information as the Director may reasonably request, including the trade or business name of the applicant; the names and addresses of the customers to be served; the route or routes proposed to be used in servicing the customers; and the names of other municipalities in which the applicant collects, transports and/or disposes of solid waste. Satisfactory evidence of liability insurance, in amounts and covering risks as the Director may reasonably require shall be a prerequisite for a license.
(B) License denial. A license will be denied in the discretion of the Director for any of the following reasons, among others:
(1) The applicant has been irresponsible in the conduct of solid waste collection, transportation and/or disposal as evidenced by previous suspensions and/or revocations of licenses in the town, or elsewhere;
(2) The applicant lacks suitable equipment with which to collect, transport and/or dispose of solid waste in compliance with this chapter;
(3) The applicant has not fully compiled with solid waste collection licensing requirements or paid fees therefor as respects the town or any other municipality or the authority; and
(4) The applicant’s vehicles and/or equipment do not conform to the requirements of this chapter or to standards established by the authority or the Director.
(C) Licenses. Non-transferable licenses will be issued for a period of one year, unless sooner revoked, commencing on July 1. No solid waste collector shall engage in the business of collecting refuse in the town without a license currently in force.
(D) Transfer of business, customers or routes. If a licensed solid waste collector (hereinafter referred to as a “licensee”) wishes to sell, lease, license, loan or in any manner or to any effect transfer all or any part of his or her business, customers or service route to another solid waste collector, the licensee shall give written notice thereof to the Director at least ten business days before the effective date of the transfer:
(1) Stating the name, address and telephone number of the transferee;
(2) A clear and concise description of the nature and extent of the business being transferred; and
(3) The effective date of the transfer.
