123.05 SPECIAL ASSESSMENT POLICY.
   (a)   Council has determined that it is beneficial to establish a consistent stated policy for special assessments.
   (b)   The Staff reports dated February 13, 1974 and March 29, 1974 examining special assessments are hereby received, approved and ordered filed.
   (c)   The base map for the Major Street Plan adopted by the Planning Commission on November 16, 1965 and Council on October 4, 1966, the base map for the General Plan of Sanitary Truck Sewers dated November, 1963, and the base map for the General Plan of Waterworks Improvements dated March, 1966, as maintained and updated are hereby ordered filed for purposes of defining the various elements of the assessment policy.
   (d)   The following constitute the elements of the assessment policy guidelines for special assessments:
      (1)   What to assess.
         A.   Streets. All street improvements including street reconstruction.
         B.   Utilities. All sewer and water line construction.
         C.   Curb, gutter and sidewalk repairs.
      (2)   How much to assess.
         A.   Streets. Property shall be assessed for street improvements for curb, gutter, sidewalks, trees and driveways for new construction or reconstruction of both residential and major streets.
         B.   Utilities. All residential utility projects shall be assessed to a standard residential service size (eight-inch sewer and six inch water.) Trunk lines shall be assessed to the total area served and interceptors shall be paid for by the City.
         C.   Curb, gutter and sidewalk repairs. The total cost of the repairs shall be assessed to property owners.
      (3)   How to assess.
         A.   Streets. Assessments for curb, gutter, sidewalks, trees and driveways shall be on a front foot basis unless fifty-one percent of the property owners affected petition for an alternate method of assessment, provided such method is specified and permitted by the Ohio Revised Code.
   Assessment for curb, gutter and sidewalks for corner lots shall be 100 percent of the front lot and 100 percent of the side lot.
   Assessments for projects on State or County routes which receive State or County funds will not be altered. The funds received will be applied to the City's share of the project costs.
   Assessments for projects which include cul-de-sacs will be based upon the front foot cost of curb, gutter, sidewalks, trees and driveways. Should Council determine that this is excessive, it may distribute a portion of the cost over the total project.
         B.   Utilities. Assessments for residential utility projects shall be assessed on a front foot basis, unless fifty-one percent of the residents affected petition for an alternate method of assessment. Assessments for trunk lines shall be assessed to the total area served (drainage area) on a square foot basis, provided such method is specified and permitted by the Ohio Revised Code.
         C.   Curb, gutter and sidewalk repairs. Assessments for curb, gutter and sidewalk repairs shall be on a front foot basis.
