351.161 SNOW EMERGENCY LEVELS.
   (a)   When, in the judgment of the City Manager, snow, sleet, freezing rain or other weather conditions cause or appear likely to cause slippery or hazardous conditions which might lead to serious congestion or hazard, the City Manager may declare a snow emergency. The City Manager shall also declare the termination of such snow emergency as soon as conditions permit.
   (b)   Snow emergencies are classified into one of three levels:
      (1)   Level I. Roadways are hazardous with blowing and drifting snow. Roads are also icy. Citizens should drive cautiously.
      (2)   Level II. Roadways are hazardous with blowing and drifting snow. Only those who feel it necessary to drive should be out on the roadways. Citizens should contact employers to determine if they should report to work.
      (3)   Level III. All roadways are closed to nonemergency personnel. No one should be out during these conditions. Those traveling on roadways may subject themselves to arrest.
   (c)   An individual’s operation of a motor vehicle during the no-driving provision of subsection (b)(3) hereof shall constitute prima-facie evidence of misconduct at an emergency, Section 509.05(a)(2), and in addition to the penalty provided for in Section 509.05(c) such individual’s vehicle shall be subject to the removal and impounding provisions of Section 303.08.
