125.02 SPECIFIC DUTIES OF CITY ATTORNEY.
   The City Attorney shall:
   (a)   Prepare all contracts, bonds and other instruments in writing in which the City is concerned.
   (b)   Serve the several directors and officers as legal counsel and attorney.
   (c)   Be the prosecuting attorney of the Mayor's court.
   (d)   When required to do so by resolution of Council, prosecute and defend on behalf of the City, all complaints, suits and controversies in which the City is a party, and such other suits, matters and controversies as the City Attorney is by resolution or ordinance directed to prosecute. The City Attorney shall not be required to prosecute any action before the Mayor for violation of an ordinance without first advising such action.
   (e)   Within a reasonable time, reply orally or in writing to an inquiry of an officer of the City who entertains doubts concerning the law in any matter before such officer in his official capacity, which inquiry clearly states in writing the question upon which the opinion is desired. The right conferred upon such officers by this subsection extends to Council and to each board and commission provided by Charter, this Administrative Code or otherwise by Council.
   (f)   Apply, in the name of the City, to a court of competent jurisdiction for an order of injunction to restrain the misapplication of City funds, the abuse of its corporate powers, or the execution or performance of any contract made in behalf of the City in contravention of the laws or ordinances governing it, or which was procured by fraud or corruption.
   (g)   Apply for the forfeiture or the specific performance of an obligation or contract made on behalf of the City, granting a right or easement or creating a pubic duty, which is being evaded or violated.
   (h)   Apply to a court of competent jurisdiction for a writ of mandamus to compel the performance of a duty, in case an officer or board or commission of the City fails to perform any duty expressly enjoyed by law or ordinance.
   (i)   Make a report to Council, at its first regular meeting in January, of the business of the office of City Attorney and such other matters as the City Attorney may deem proper to promote the good government and welfare of the City.
