(a) Flood Hazard Area Development Permit Required.
A flood hazard area development permit shall be obtained before construction or development begins within any area of special flood hazard established in Chapter 1137. Application for a development permit shall be made on forms furnished by the Zoning Administrator and may include, but not be limited to: Plans in triplicate drawn to scale showing the nature, location, dimensions and elevations of the area in question; existing or proposed structures, fill, storage of materials, drainage facilities and the location of the foregoing; and a description of the extent to which any watercourse will be altered or relocated as a result of proposed development.
(1) If base flood elevation data are available, the following information is also required:
A. Elevation in relation to mean sea level of the lowest floor, including basement, of all proposed structures; and
B. Elevation in relation to mean sea level to which any proposed structure will be floodproofed; and
C. Certification by a registered professional engineer or architect that the floodproofing methods for any nonresidential structure meet the floodproofing criteria in subsection (b)(2) hereof.
(2) The fee for a flood hazard area development permit shall be $50.00, in addition to fees for building and zoning permits.
(b) Designation of Administrators; Duties and Responsibilities.
(1) The Building and Zoning Administrators are hereby appointed to administer this chapter and Chapter 1137 by granting or denying flood hazard area development permit applications in accordance with their provisions.
(2) The Building and Zoning Administrators shall:
A. Review all flood hazard area development permits to determine that the permit requirements of this chapter and of Chapter 1137 have been satisfied.
B. Review all flood hazard area development permits to assure that all necessary permits have been received from those federal, state or local governmental agencies from which prior approval is required. The applicant shall be responsible for obtaining such permits as required.
C. Review all flood hazard area development permits to determine if the proposed development is located within a designated floodway. Floodways may be delineated in other sources of flood information. If the proposed development is located within a designated floodway, assure that the encroachment standard in subsection (b)(5) hereof is met.
(3) Areas of special flood hazard where base flood elevation data have not been provided by the Federal Emergency Management Agency are designated as Zone A on the City's Flood Insurance Rate Map. Within these areas, the Building and Zoning Administrators shall obtain, review and reasonably utilize any base flood elevation and floodway data available from a federal, state or other source in order to administer subsection (b) hereof.
(4) Where bases flood elevation data area utilized within areas of special flood hazard on the City's Flood Insurance Rate Map, regardless of the source of such data, the Building and Zoning Administrators shall:
A. Obtain and record the actual elevation (in relation to mean sea level) of the lowest floor, including basement, of all new or substantially improved structures and whether or not such structures contain a basement.
B. For all new or substantially improved floodproofed structures:
1. Verify and record the actual elevation (in relation to mean sea level) to which the structure was floodproofed; and
2. Maintain the floodproofing certifications required in subsection (a)(1)C. hereof.
C. Maintain for public inspection all records pertaining to the provisions of this chapter and of Chapter 1137.
(5) Where a watercourse is proposed to be altered, the Building and Zoning Administrators shall:
A. Notify adjacent communities and the Ohio Department of Natural Resources, Division of Water, prior to any alteration or relocation of a watercourse and submit evidence of such notification to the Federal Emergency Management Agency.
B. Require that necessary maintenance will be provided for by the applicant, his successors or assigns for the altered or relocated portion of said watercourse so that the flood carrying capacity will not be diminished.
(6) The Zoning Administrator shall: Make interpretations where needed as to the exact location of the boundaries of the areas of special flood hazards (for example, where there appears to be a conflict between a mapped boundary and actual field conditions). Any affected person contesting the location of the boundary may appeal the interpretation pursuant to Chapter 1127.
