The City shall have the right to cause the removal of any dead or diseased trees on private property within the City, when such trees constitute a hazard to life and property, or harbor insects or disease which constitute a potential threat to other trees within the City. The Service Director will notify in writing the owners of such trees. Removal shall be done by said owners at their own expense within sixty days after the date of service of notice. In the event of failure of owners to comply with such provisions, the City shall have the authority to remove such trees and charge the cost of removal on the owner's property tax notice.

(a) It shall be unlawful for any person to prevent, delay or interfere with the City, the Service Director, or any of their agents while engaged in carrying out the execution or enforcement of the chapter.
(b) The employees and agents of the City shall have the right of access to all property in the City for the purpose of inspecting any trees and shrubs to determine the necessity of their removal and for the purpose of performing the necessary work should the owner fail to do so.

(a) It shall be unlawful for any person or firm to engage in the business or occupation of pruning, treating, or removing street or public trees within the City without first applying for a City permit and paying a fee. Proof of certification or training in proper tree pruning techniques is required. Before the permit shall be issued, each applicant shall first file evidence of possession of liability insurance in the minimum amounts of five hundred thousand dollars ($500,000) for bodily injury and one hundred thousand dollars ($100,000) property damage indemnifying the City or any person injured or damaged resulting from the pursuit of such endeavors as herein described.
(b) No person shall plant, prune or remove any tree in the public right-of-way without first receiving a permit from the Service Director. Any tree planted shall meet the requirements of this ordinance as to species and spacing.
