935.08 TREE MAINTENANCE.
   (a)   The City shall have the right to plant, prune, maintain and remove trees, plants and shrubs within the tree lawn/public right of way of all streets, alleys, avenues, lanes, squares and public grounds, as may be necessary to insure public safety or to preserve or enhance the symmetry and beauty of tree lawn/public right of way. Pruning shall be done in accordance with the standards set forth in the Pruning Standard for shade trees in the tree plan. Climbing spikes shall not be allowed except when the tree is to be removed.
   (b)   The City Service Director, under the advice of a licensed arborist, may remove or cause or order to be removed, any street tree or part thereof which is in a public hazard constituting an unsafe condition which by reason of its nature is injurious to persons, public and private property, sewers, electrical power lines, gas lines, water lines, or other public improvements, or is affected with any injurious fungus, insect or other pest. This section does not prohibit the planting or pruning of Street Trees by adjacent property owners providing that the selection and location of said trees is in accordance with Sections 935.05 through 935.07 and pruning is in accordance with the tree plan.
