Fermenting, putrefying, odoriferous garbage, refuse or recyclable materials in containers uncollected or dumped in the open due to failure to pay for garbage, refuse or recyclable materials service charges, or otherwise, is hereby declared to be a public nuisance and the person responsible for the same shall be subject to a penalty provided for in Section 931.99 and the cost of the cleanup will be assessed to the property owner.
