(a) Franchise Area. The Franchise area or Service area relates to the present territorial limits of the City and to any area henceforth added thereto, by annexation or otherwise, during the term of this agreement and/or renewal(s) thereof.
(b) Required Extensions of Service. Franchisee is hereby required to extend the cable system within the territory of the City. Franchisee shall do so whenever Franchisee shall receive a request for service from an area that includes at least twenty-five dwelling units within 5280 cable-bearing strand feet (one cable mile) of its trunk or distribution cable, it shall extend its cable system to such potential subscribers at no cost to said subscribers for system extension, other than the usual connection fees for all subscribers.
(1) In addition, the City Manager may upon request from any potential subscriber residing in the City, order the extension of the system to each subscriber after opportunity for hearing and notice of the franchisee. In such cases, the City Manager in his discretion may order such extension to any such subscriber only upon a reasonable contribution from the subscriber to the cost of such extension, such cost not to exceed the actual cost of time, materials and overhead required for such extension, less the cost of time, materials and overhead required to extend the system two hundred fifty (250) feet from its existing system.
(2) All extensions of the cable system required by this section shall be constructed and completely operational within one (1) year from the latter of the date of the request or the date the City Manager approves the request, if required.
