549.08 DISCHARGING FIREARMS.
   (a)   No person shall discharge any BB gun, air gun, rifle, shotgun, revolver, pistol or other firearm within the corporate limits of the Municipality.
   (b)   This section does not apply when firearms are used in self defense, in the discharge of official duty or when otherwise lawfully authorized, nor shall this section apply when a BB gun is discharged by a person 18 years of age, or older, upon said person’s own property, or with permission from the owner of such property, for the purpose of exterminating undesirable varmints or birds.
   (c)   Whoever violates this section is guilty of a misdemeanor of the fourth degree.

   (d)   This section shall not apply if the firearm which is discharged was used or was on or about the person or under the control of the person in the commission of a felony for which the Ohio Revised Code requires a term of actual incarceration for three years and an indefinite term of imprisonment pursuant to Ohio R.C. 2929.71(B).
