6-1-12: RESPONSIBILITY FOR FAILURE TO ABATE DUST AND MITIGATE DAMAGE:
   A.    Failure To Abate: The owner and operator of any vehicle who fails to abate dust created by operation of the vehicle, when dust abatement is necessary to prevent or mitigate damage to the road and when the need for dust abatement has been specifically brought to the attention of the owner and/or operator in a written notice provided by the county road supervisor, shall be jointly and severally responsible for all damage which the road may sustain as a result of the operation of the vehicle and the failure to abate dust.
   B.    Failure To Mitigate: The owner and operator of any vehicle who fails to take action to mitigate damage to the road resulting from operation of the vehicle, when the need for mitigation has been specifically brought to the attention of the owner and/or operator in a written notice provided by the county road supervisor, shall be jointly and severally responsible for all damage which the road may sustain as a result of the operation of the vehicle and the failure to take mitigation action.
