A. Hours Restricted: It shall be unlawful for any person to be within the area known as the Jump Creek recreation site, otherwise described as T2N, R5W section 27, SE1/4SW1/4NW1/4, S1/2SE1/4NW1/4, E1/2NW1/4SW1/4, W1/2NE1/4SW1/4, NE1/4NE1/4SW1/4 in Owyhee County, Idaho, before and/or after the specified hours on the months referenced hereinbelow:
1. Spring, Summer And Fall Hours: April 1 through October 1 of each year, six o'clock (6:00) A.M. through nine o'clock (9:00) P.M.
2. Winter Hours: October 2 through March 30 of each year, eight o'clock (8:00) A.M. through six o'clock (6:00) P.M.
B. Exceptions: Exceptions from the provisions of subsection A of this section are federal, state or local government personnel on official duty, emergency service personnel on official duty, public utility personnel performing emergency utility services, and other persons licensed or permitted to be within the site during the hours of prohibition.
C. Violation:
1. Penalty: Violation for being within the Jump Creek site shall be an infraction and subject to penalty as provided in section 1-4-1 of this code.
2. Disposition Of Portion Of Fine: The portion of any fine imposed for a violation of this section which is designated for distribution to the county shall be paid into the search and rescue account in the budget of the sheriff's office. (Ord. 2016-03, 11-7-2016, eff. 1-1-2017)
