All excavations in the streets, alleys, sidewalks and other public places within the county shall require the prior approval of the County Highway Superintendent; provided, however, that the Highway Supervisor may recommend and the county executive may requite adequate assurance that such public way or property be restored to its condition prior to such excavation. This assurance may be in the form of a performance bond, or such other surety as the county executive shall determine.
