(A) Fines for violation of this chapter are established as follows:
First offense | Written warning |
Second offense | $100 |
Third offense | $150 |
Fourth offense and each subsequent offense | $250 |
(B) In addition to the penalties provided for in division (A) above, any act or any person, firm or corporation who continuously, knowingly and intentionally violates any provisions of this chapter may be declared to be a nuisance and all remedies applicable to a nuisance, both public and private, including, but not limited to injunctions and damages, are hereby preserved. Whoever creates or maintains any nuisance and fails or refuses to abate the nuisance when so ordered shall be subject to an additional fine of not more than $200 and not to exceed $2,500. A separate offense shall be deemed committed upon each day during or on which the violation occurs or continues beyond the date fixed by the Sheriff’s Department for abatement of the nuisance.
